The amount of bail set is proportionate to both the crime alleged and the defendant’s personal flight risk. Bail is used as a way of ensuring that a defendant will show up for his court appearances if he is allowed to leave the jail and go free until sentencing.

Unfortunately, for some, posting bond can be difficult. Yet, when you or your loved one is stuck in jail, nothing seems more important. There are a handful of ways to pay bond in Texas. What Ways Can I Pay Bail in Texas?

Once you have seen a judge and your bond has been set, there are several options for paying it and being released from jail. However, if you do not want to remain in jail until you can see a judge, an attorney writ bond is likely your best - and only - option to get released. In Texas, the main ways to post bail include:

  • Cash bond - You pay the full amount of the bond and receive most of it back at the conclusion of the case. Many people cannot afford to put down the full amount, so this is often not an option.
  • Surety bond - When you hire a bondsman, you pay them an amount roughly equal to 10 or 20 percent of the total bond, which you do not get back. If you miss a court date, the bondsman is liable for the full amount of the bond, but will come looking for you.
  • Property Bond - If you own real estate that covers more than the cost of the bond, the court may allow you to put the deed to that property up in lieu of cash. However, the downside is that you could lose that property over a bond violation.
  • Personal Recognizance - In some cases where the defendant is not a flight risk, the court may release him without paying a bond. You may, however, have to report to a bond office while your case is pending and pay associated fees.
  • Attorney writ bond - If you use an attorney writ bond to get out of jail, you may be released even before seeing a judge. While not everyone is eligible to be released on an attorney writ bond, they can be an excellent option for those who are.
